THE LEGAL PRACTICE COURSE (LPC)

Batch XIV

Budidjaja Institute in collaboration with Budidjaja International Lawyers and Lawyerindo Legal Support Center will hold a Legal Practice Course (the "Course") on 29 - 30 January 2020. The Course offers comprehensive legal practice foundation training on fundamental lawyering skills, as well as impartation of practical legal and business knowledge in the following areas, including: Lawyers Ethics and Orientation on the Practice of Law, Contract Drafting, and Introduction to Legal Due Diligence, Fundamental Lawyering Skills and Basic Principles for Legal Writing.

Limited successful Course participants will also be considered for an opportunity to participate in 2-3 months apprenticeship program at Budidjaja International Lawyers in collaboration with Lawyerindo Legal Support Center and a limited number of participants will be given invitations for further career opportunities at the end of the apprenticeship program (subject to vacant position).

Waiver of Participation Contribution (“Scholarship”) will be offered to limited applicants who have outstanding qualifications based on the discretion of the recruitment committee. If you wish to be considered for a Scholarship, you need to fulfill the following requirements:

1. Indicate in your application with the subject Legal Practice Course Registration – Scholarship

2. Possess minimum GPA 3,0 out of 4.00 as reflected in the Academic Transcript;

3. Submit a legal opinion regarding one of the following topics (min. 1,000 words max. 1,500 words):

A. The government of the Republic of Indonesia plans to issue Omnibus Laws, which include, inter alia, draft Law on Creation of Employment Opportunities and draft Law on the Development and Strengthen of Economic Sector. Please give your opinion on the concept of Omnibus Law from the perspective of theory and practice of the formulation of law and regulations? What’s needed to be cautious by the government when drafting the Omnibus Law as it will be unifying and revoking more than a hundred regulations?

 

B. Indonesian Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha/ KPPU) issued KPPU Regulation No. 3 of 2019 on the Assessment of Mergers and Consolidations of Undertakings or Acquisition of Shares in a Company that May Result in Monopolistic Practices and/or Unhealthy Competition. The notable provision under the regulation is a transfer of assets (with or without shares) is commensurate to an acquisition of shares and, should be notified to the KPPU. The notification must be reported if, among others, the transfer of assets results in a transfer of management control and/or physical control over the assets with a certain threshold value;

 

Please elaborate your opinion and assessment on the impact and the implementation of such provision for the company whose assets have been reaching the threshold value even prior to transfer of physical control over assets. Also explain if there are any other provisions which may be problematic in practice.
